CPLR: Guangdong-Hong Kong-Macao Greater Bay Area Legal Forum “Conflict of Laws, Legal Cooperation, & Connection of Rules”
The construction of the Guangdong-Hong Kong-Macao Greater Bay Area (GBA) is a major strategic move for China's national development. On 18 February 2019, the Central Government issued the Outline of Development Plan for the Guangdong-Hong Kong-Macao Greater Bay Area which marks a new page for the construction of the GBA. The success of the GBA Project largely depends on the interoperability of legal systems and the connection of legal rules and regulations across the three regions. Under the "one country, two systems and three jurisdictions" framework, the conflict of laws within the area requires both theoretical and pragmatic solutions from academics, practitioners and policymakers. On 21 January 2022, The Public Law and Human Right Forum (CPLR) of CityU School of Law held its first legal forum, addressing the conflicts of law, legal cooperation and connection of rules within the GBA. The forum was conducted in hybrid mode. The response was overwhelming.

At the opening ceremony, Prof. Christian WAGNER (Provost of CityU) and Prof. TAN Cheng Han (Dean and Chair Professor of Commercial Law at School of Law, CityU) first delivered their welcoming speeches on behalf of CityU and CityU School of Law. We were honored to have Mr. LIU Chunhua (Director of Law Department, the Liaison Office of the Central People’s Government in the HKSAR), Mr. LIU Dexue (Director of Legal Affairs Bureau of Macao SAR Government), Prof. HUANG Jin (Professor of China University of Political Science and Law, President of Chinese Society of International Law and President of China Society of Private International Law ) and Dr. SI Xiao(Director Tencent Research Institute, Tencent Holdings Limited.) to deliver opening remarks. Legislative Council Members Ms. Eunice YUNG and Dr. Simon LEE were invited to be honorable guests.
In his opening speech, Prof. Christian WAGNER was very pleased to see that CityU Law School has always been a pioneer in conducting research of Chinese and comparative law, provide high quality legal education of Chinese law, and offered joint programmes to train Chinese judges. Mr. LIU Chunhua stated that the Liaison Office of the Central People’s Government will continue to serve as the bridge for legal cooperation and communication of the GBA. Mr. LIU Dexue emphasized that the convergence of legal rules and mechanisms should adhere to the "one country" principle and utilize comparative advantages of different legal systems. Prof. HUANG Jin raised that the conflict of laws within the area requires both theoretical and pragmatic solutions from both academics and policymakers. Dr. SI Xiao said that many hi-tech companies have been exploring new paths for the integration of the economy, society and people's livelihood and the rule of law in the GBA. On behalf of CityU School of Law, Prof. TAN Cheng Han thanked all the guests and speakers for participating in the forum. He stated that the convening of this forum is very timely and highly relevant. As the only city that practices common law in China, he believed that Hong Kong with its unique legal system can make great contribution to the GBA.

CPLR was very pleased to have Ms. Teresa CHENG (Secretary for Justice, the Government of the HKSAR) as the keynote speaker of the forum.

To deepen the connection between regional legal cooperation, she put forward the following five suggestions: Firstly, ensuring effective mutual legal assistance in civil and commercial matters is in place between the three areas. Secondly, under the "one country, two systems, three jurisdictions" framework, the area may make reference to the international law of conflict to formulate GBA’s own conflict of laws system. Thirdly, expediting the development of the legal services industry and nourish legal professionals that are able to practice across the three areas. Fourthly, expanding the free trade pilot area. Fifthly, fully leveraging the advantage and experience of Hong Kong in ADR, and developing a center for international legal and ADR service in the GBA.
Prof. ZHU Guobin observed that so far, most researches have been focusing on the macro aspects of central government policies and they present always very optimist views. The goal of this legal forum is to provide a platform for scholars, experts and governmental officials to offer their valuable practical opinions and solutions to the legal issues facing in the GBA.

The first session focused on the “Legal Response to the Construction of the GBA: Status Quo, Problems and Theoretical Reconstruction” and was chaired by Prof. WANG Jiangyu (Director of CCCL, School of Law, CityU). Session two focused on the “Connection of Rules and Innovation of Intergovernmental Cooperation in the GBA”, chaired by Prof. ZHAO Yun (Head of Department of Law, Faculty of Law, the University of Hong Kong). The third was chaired by Prof. DU Chengming (Vice President of Guangdong University of Technology) which concerned the “Judicial and Other Alternative Dispute Resolution Mechanisms and Innovations in GBA”. The fourth was chaired by Dr. Witman HUNG (Deputy of the 13th National People’s Congress of the People’s Republic of China) and focused on the topic “Legal Service Industry Cooperation and Other Legal Collaborative Scenarios in the GBA”.

At the closing ceremony, on behalf of CPLR, Prof. ZHU Guobin stated the Forum was a great success viewed from the quality of papers and the participation of leading figures representing academia, legal service industry as well as government officials. He sincerely thanked all scholars, guests and hosts, audience online and in room, for their constructive contribution and participation.
粵港澳大灣區建設是中國國家發展的重大戰略舉措。 2019年2月18日,中央政府印發《粵港澳大灣區發展規劃綱要》,這標誌著大灣區發展建設翻開新的一頁。大灣區戰略成功與否,取決於三地法律與規則銜接與機制對接。也正因為大灣區“一國兩制三法域”的固有特徵,如何進一步完善三地間的法律合作,優化製度協同創新,始終值得決策者、學術與實務界予以更系統的理論洞察與更務實的實踐探索。有鑑於此,香港城市大學公法與人權論壇 (CPLR) 於2022年 1 月 21 日舉辦了第一次粵港澳大灣區法律論壇,主題為「粵港澳大灣區法律衝突、合作與規則銜接」。會議採用現場於線上混合模式進行,參與者踴躍,反應熱烈。

開幕式中,Christian Wagner教授(香港城市大學學務副校長),陳清漢教授(香港城市大學法律學院院長)分別代表香港城市大學及香港城市大學法律學院致詞。CPLR亦有幸邀請到劉春華先生(中央人民政府駐香港特別行政區聯絡辦公室法律部部長) 、劉德學先生(澳門特別行政區政府法務局局長)、黃進教授(中國國際法學會會長、中國國際私法研究會會長、中國政法大學)及司曉博士(騰訊研究院院長) 為粵港澳大灣區法律論壇致開幕詞。立法會議員容海恩大律師和李浩然博士受邀為開幕式主禮嘉賓。
開幕式中, Christian Wagner教授致詞表示十分高興看到城大法律學院一直為研究三地法律及提供中港法律教育課程的先鋒。劉春華部長表示中聯辦法律部作為香港與內地法律交流合作的橋樑,也期待未來能繼續為內地與香港法律交流作出新貢獻。劉德學局長強調規則銜接和機制對接應堅守“一國”原則,發揮不同制度的比較優勢。他結語鼓勵所有關注大灣區建設的專家們建言獻策、貢獻力量。黃進教授表示大灣區的規則對接問題須由三地的學術界、實務界及決策者予以系統的的理論洞察及務實的實踐探索。 司曉博士表示近年諸多的科技企業都在探索科技大灣區經濟社會民生以及法治融合的新路徑。陳漢清教授代表香港城市大學法律學院感謝各地來賓與會。他表示是次論壇主題非常及時, 並寄語香港作為中國唯一一個採取普通法的城市,相信其獨特法制能為大灣區作出巨大貢獻。

CPLR非常高興邀請到鄭若驊女士(香港特別行政區政府律政司司長)擔任論壇主旨演講嘉賓。

就進一步加強區域法律合作與規則銜接,鄭司長提出以下五個方面的建議。第一,建設三地民商事司法協助制度。 二、在「一國、兩制、三法域」大框架下,三地可參照相關國際法律衝突規則制定三地規則銜接。第三,培養熟悉三地法域的相關法律專才及交流機制對接,已有的大灣區考試及聯席會議制度加強了三地法律服務合作 。第四,進一步擴展自由貿易試驗區。第五,運用香港的獨特優勢和發展調解服務的經驗在大灣區建設跨境調解機制 。她最後祝願論壇能取得圓滿成功。
就此法律論壇的主旨與目標,朱國斌教授(香港城市大學公法與人權論壇主任)表示目前研究主要聚焦於中央宏觀政策層面和政策應對,提出的見解亦非常樂觀。有見及此,希望是次論壇能提供一個平臺給諸位專家學者與政府要員就大灣區建設的法律實務與理論問題發表真知灼見,並提出可行的建議。

法律論壇第一節主題為粵港澳大灣區建設的法律應對:現狀、問題與理論重建。此環節由王江雨教授(香港城市大學法學院;中國法與比較法研究中心主任)主持。法律論壇的第二節主題為粵港澳大灣區府際合作之規則銜接與創新。此環節由趙雲教授(香港大學法律學院主任)主持。法律論壇的第三節主題為粵港澳大灣區司法與其他爭端解決機制及其創新。此環節由杜承銘教授(廣東工業大學副校長)主持。法律論壇的第四節主題為粵港澳大灣區法律服務業合作與對接及其他法律協作場景。此環節由洪為民博士(全國人民代表大會代表)主持。

朱國斌教授主持了簡短的會議閉幕式, 特別代表公法與人權論壇感謝觀眾、嘉賓、主持演講人、各地政府要員和專家學者對此論壇的參與及貢獻,各專家發表的學術文章亦具前瞻性。他表示會議非常成功。
